  • Expunged Records Not Public

Posted by Andy on October 9th, 2006

It is getting interesting in the 5th District. Alan Fine had an expunged record released to the Star Tribune, well he didn’thave it done. Someone leaked his record.

Q: If my criminal case is expunged, what happens to my court record?

A sealed state court record still exists but it is “invisible” to the general public. If the expunged crime was the only crime on your record, you will not have a court record that the public can see. Employers and landlords cannot see sealed records; law enforcement and immigration agencies can see them. (Source: MN Judicial Branch)

Only government agencies had access to this private record. Who done it?

    1. Joe Tucci Says:

Fine “leaked” the pre-expungement records earllier this year. He was talking about it on the radio this morning. He provided them to a Strib reporter who had contacted him, wanting to give them the whole story.

A mistake that i’m sure nobody else will henceforth replicate (trusting a Stribling).

    2. DJZ Says:

Probably his wife or her father a Judge.

    3. Kevin Says:

DJZ makes a point. His wifes father is a Hennepin County Judge.

    4. Andy Says:

Regardless, it is not something someone can release. That is why it was expunged. If it was his Dad, then his Father may be in big trouble.

So wait. It is now ok to release private documents for political means.

Great. Where the fuck are the rose lawfirm papers?

Has anyone found that box yet?

    5. Rantirator Says:

Alan Fine himself provided the information to the Strib in July, as I recall.

    6. Andy Says:

      Rant,
If true, did he give them permission to publish them?

    7. Rantirator Says:

I don’t really know, I just remember this from (I think?) his press release responding to the Strib. Y’know, where he mentioned that the timing of this piece was strategic (read: LATE) relative to when they actually got the info. He probably has the press release on his website… or you could email him and ask.

    8. Kevin Says:

Andy, I agree if it was the Judge father then yeah, he’s in alot of trouble. Well at least he should be, more than likely he’ll just get a slap on the wrist.

    9. Rantirator Says:

Alternatatively, you could ask him in person, tonight at:
