Sorry. You're not stupid, you just don't seem to have any historical perspective that the rights in the Magna Carta aren't what we'll "fall back on." The 800 year old rights in the Magna Carta are what the GOP's Torture Bill eliminates for anyone the President (yes, including the next Democratic one that's in power, you short-sighetd fools) decides to label an "enemy combatant."
